ACTIVE STATE AND FEDERAL COMPLAINTS FILED AGAINST BLOOMINGTON,
MINNESOTA EDIBLE-PRODUCTS BUSINESS OVER ALLEGED CONSUMER FRAUD

BLOOMINGTON, MINNESOTA — A consumer-advocacy publication has
released full source materials documenting four active
regulatory complaints filed against Nutrition Excellence LLC,
operating as "Nutrition Elements" and "Moonshot Gummies," and
its principal Evan Bosma. The complaints allege consumer fraud,
product misbranding, document irregularities, unsanitary
manufacturing conditions, and unauthorized employee surveillance.

The complaints were filed August 2, 2026, with:

  - Minnesota Department of Health (complaint filed) —
    regarding alleged unsanitary manufacturing conditions at a
    commercial office suite in Bloomington.

  - Minnesota Office of Cannabis Management — regarding alleged
    fraudulent cannabinoid-product labeling.

  - North Dakota Department of Agriculture — regarding alleged
    adulterated and misbranded hemp products shipped across
    state lines.

  - Federal Bureau of Investigation, Minneapolis Field Office —
    regarding alleged interstate fraud and alleged wire fraud in
    commerce of controlled substances.

ALLEGATIONS DOCUMENTED IN THE PUBLICATION

than 21,000 contemporaneous text-message records with verbatim
admissions from the principal, and production documentation
allegedly demonstrating product substitution between
Minnesota-formulated products (labeled 0 mg CBD per Minnesota
regulatory framework) and North Dakota-labeled retail packaging
claiming 75 mg CBD per serving.

STATUTORY CONCERNS IDENTIFIED

The publication identifies the following statutory concerns as
relevant to the allegations:

  - 21 U.S.C. § 331 — Misbranded or adulterated food in
    interstate commerce.
  - 21 C.F.R. Part 117 — Current Good Manufacturing Practice
    for food.
  - 18 U.S.C. § 2511 — Unauthorized interception of electronic
    communications.
  - North Dakota Century Code § 19-24.1 — Hemp product testing
    and labeling.
  - Minnesota Statute § 31.101 — Food-establishment sanitation.
